DDLA Sports Farm — Participant Waiver, Release of Liability, and Consent

This agreement is between DDLA Sports Farm (“DDLA”), 6440 Crabgrass Rd, St. Cloud, FL, and the parent or legal guardian signing below, for themselves and for each athlete listed above (each a “Participant”). It covers every DDLA program and visit — including training camps, after-school training, private training, DDLA Prep, practices, evaluations, and events — at the DDLA property or anywhere DDLA runs them, for 12 months from the date signed.

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF DDLA SPORTS FARM USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM DDLA SPORTS FARM IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND DDLA SPORTS FARM HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

1. Activities and their risks

Participants may take part in baseball and softball training (hitting, fielding, throwing, pitching, base running, and live play), batting cages and pitching machines, speed, agility, and conditioning drills, strength training and gym work, and farm activities on the property, including being around horses and other animals, ponds, and open fields.

These activities have risks that are a natural part of them and cannot be fully removed, even when DDLA uses reasonable care. They include being hit by thrown or batted balls or bats; collisions, falls, slides, and dives; sprains, strains, broken bones, dental and eye injuries, and concussions; overexertion, heat illness, sun exposure, and dehydration in Florida weather; lightning and sudden storms; uneven ground, insects, snakes, and wildlife; water around ponds; and the unpredictable behavior of horses and other animals.

WARNING

Under Florida law, an equine activity sponsor or equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.

2. Health and fitness

I confirm that each Participant is in good health and physically able to take part, and that I have told DDLA above about any medical condition, allergy, injury, or medication that could affect their participation or safety. I will tell DDLA if anything changes. DDLA staff may remove a Participant from any activity at any time for safety.

3. Concussions

Any Participant who shows signs of a concussion will be removed from activity and will not return until a licensed health care provider clears them in writing.

4. Emergency medical care

If a Participant is injured or becomes ill and I cannot be reached right away, I authorize DDLA staff to give first aid and to arrange emergency medical care, including transport to a hospital, and I authorize the treating providers to treat the Participant. I am responsible for the cost of that care.

5. Assumption of risk, release, and waiver

I understand the risks described in this agreement and I voluntarily accept them, for myself and for each Participant. To the fullest extent allowed by Florida law, I release and waive, and agree not to sue, DDLA Sports Farm, its owners, coaches, staff, and volunteers, and the owners of the property (the “Released Parties”) for any personal injury, including death, or property damage to a Participant that results from the inherent risks of these activities. For any claim that is my own as an adult, this release also covers the ordinary negligence of the Released Parties. Nothing in this agreement releases gross negligence or intentional misconduct.

6. Rules, conduct, and supervision

Participants must follow coach instructions and DDLA safety rules, wear the required gear (including a batting helmet when hitting and running bases), and stay in supervised areas. Horses, other animals, and ponds are off-limits unless a staff member is supervising. DDLA may send home a Participant whose behavior puts themselves or others at risk. Parents and guardians are responsible for drop-off and pick-up at the scheduled times.

7. Photos and video

DDLA takes photos and video during programs. My choice below says whether DDLA may use images and video of the Participants on its website, social media, and promotional materials. I can change my choice at any time by contacting DDLA.

8. Electronic signature and general terms

I agree that typing my name and drawing my signature below is my electronic signature and has the same effect as signing on paper, and that I can ask DDLA for a copy at any time. Florida law governs this agreement. If any part of it is found unenforceable, the rest stays in effect. This is the entire agreement about the matters it covers.

I have read this entire agreement, I understand it, and I sign it voluntarily.
